These Terms of Service (the “Terms”) are a binding agreement between you and TShirtTube (“TShirtTube”, “we”, “our”, or “the platform”). By accessing or using TShirtTube — including creating an account, uploading content, or purchasing any product — you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the platform or any associated products, websites, or services.
Before you upload anything, read this: You may only upload designs, artwork, logos, photographs, or images of a person’s face or likeness that you own outright, or that you have explicit written permission and all legal rights to use, print, and sell. If an image shows a person, you must be that person or have their written consent (and a parent/guardian’s consent for anyone under 18). By uploading, you take full legal responsibility for that content and you agree to reimburse TShirtTube for any claim that results from it. See Section 6 for full details.
TShirtTube is a custom apparel and print-on-demand platform where users can design, customize, and purchase physical products (including apparel that may feature user-supplied faces and designs) connected to interactive digital item profiles, games, and community features. Many products are made to order based on the content you provide.
Estimated shipping times are provided during checkout. Delays may occur due to production schedules, inventory, or external factors such as carriers. Risk of loss passes to you upon our delivery of the product to the carrier.
When you place a custom order, you direct TShirtTube to reproduce your uploaded or selected content onto a physical product. TShirtTube acts as the producer of an item you designed; you are solely responsible for the content you submit. We do not pre-screen all content and are not obligated to do so, but we may reject, cancel, or refund any order at our discretion (see Sections 6–8).
You keep ownership of the original content you upload (“User Content”). However, as a strict condition of uploading, you represent and warrant that:
You acknowledge that TShirtTube relies on these representations to produce your order, and that you — not TShirtTube — are the party responsible for ensuring you have the right to everything you upload. If you are unsure whether you have the rights to an image or a person’s face, do not upload it.
By uploading or submitting User Content, you grant TShirtTube a worldwide, non-exclusive, royalty-free license to host, store, reproduce, print, manufacture, display, and distribute that User Content solely as needed to operate the platform and to produce, fulfill, market, and support your orders. This license ends when you delete your User Content or close your account, except to the extent (a) it is needed to complete transactions already in progress, or (b) we must retain records to comply with law or resolve disputes. This section does not transfer ownership of your User Content to us.
We may, but are not required to, review User Content. We reserve the right, at our sole discretion and without liability, to refuse, cancel, delay, or remove any User Content or order that we believe may violate these Terms, infringe a third party’s rights, or expose TShirtTube to legal risk. If we cancel an unfulfilled order for this reason, we will refund amounts paid for that order.
TShirtTube respects intellectual property rights and expects users to do the same. If you believe content on the platform infringes your copyright, send a written notice to our designated agent that includes: (1) your signature (physical or electronic); (2) identification of the work claimed to be infringed; (3) identification of the infringing material and where it is located; (4) your contact information; (5) a statement that you have a good-faith belief the use is not authorized; and (6) a statement, under penalty of perjury, that the information is accurate and that you are the rights holder or authorized to act on their behalf.
Designated agent for copyright and intellectual-property notices: copyright@tshirttube.com. We will respond to valid notices, may remove or disable the material, and will terminate the accounts of repeat infringers. Submitting a false claim may expose you to liability.
Physical products may unlock digital features such as item profiles, levels, challenges, or exclusive content. These digital mechanics are provided for entertainment, are not a guarantee of monetary value, and can change or be discontinued at any time.
NFC functionality may depend on your device. We are not responsible for phone compatibility issues or for damage caused by improper use of tags.
Some items include capped inventories or special access perks intended for entertainment and collection purposes. We do not guarantee resale value or investment returns.
Because custom items are made to order, they are generally non-refundable except where required by law or where the product is defective or materially different from what you ordered. Support requests must be submitted through our Support Page. Refunds are approved at the reasonable discretion of TShirtTube.
We may suspend, restrict, or terminate access to services or accounts at any time if we believe these Terms were violated or that harmful, fraudulent, or infringing activity is occurring. Sections that by their nature should survive termination — including Sections 6, 7, 17, 18, 19, and 20 — will survive.
TShirtTube provides the platform and services “as-is” and “as-available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted, secure, or error-free operation. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
To the maximum extent permitted by law, TShirtTube and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of or related to your use of the platform. To the maximum extent permitted by law, our total liability for any claim relating to the platform or a product will not exceed the amount you paid to TShirtTube for the product or transaction giving rise to the claim.
You agree to defend, indemnify, and hold harmless TShirtTube and its owners, officers, employees, contractors, and suppliers from and against any claims, demands, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your User Content, including any claim that it infringes or violates a third party’s copyright, trademark, right of publicity, privacy, or other rights; (b) your use of the platform; (c) your violation of these Terms; or (d) your violation of any law or the rights of a third party. This obligation applies whether or not TShirtTube reviewed or approved your content, and survives termination of your account.
These Terms are governed by the laws of the State of [YOUR STATE], United States, without regard to conflict-of-laws rules. Except where prohibited by law, you and TShirtTube agree that any dispute will be resolved through binding individual arbitration or in the courts located in [YOUR COUNTY/STATE], and that disputes will be brought on an individual basis only — not as a plaintiff or class member in any class or representative action. If any part of this section is found unenforceable, the remainder stays in effect.
We may update these Terms from time to time. We will post the newest version on this page and update the “Last updated” date. Continued use of TShirtTube after changes take effect means you accept the updated Terms.
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, are the entire agreement between you and TShirtTube regarding the platform.
